• Commercial real estate Buyers and Sellers. Sue Fox represents companies and individuals with all aspects of real estate purchase-and-sale transactions, from initial negotiation, contracting and financing through inspection issues, title review, closing and post-closing issues. Her clients include investors and business owner-users alike, and the legal services often include formation of holding entities such as limited liability companies and “Sub-chapter S” corporations. Developers. Sue Fox has represented developers of grocery-anchored shopping centers; other retail, office and entertainment venue developers, and developers of condominium and rehabilitation projects. She works on acquisition, financing and entitlement issues and documentation, negotiates and prepares subdivision improvement and other developer-government agreements, drafts covenants, conditions, easements, restrictions, party-wall agreements and other agreements which affect the use of the property. Finally, she works on leasing of the developed project and its ultimate sale. Commercial landlords. Sue Fox represents landlords of all categories of commercial properties – office, retail, industrial and warehouse/office flex space – in negotiating and leasing their properties. Commercial tenants. Sue Fox represents commercial tenants leasing office, retail, industrial and warehouse/office space. She also assists subtenants and tenants in the role of sub-landlords.
• Residential real estate Sue Fox helps buyers and sellers of homes to complete their transactions, both those involving brokers and “for sale by owner” transactions. Her work includes review or drafting of the purchase-and-sale contract and related documents, dealing with inspection issues, title review, review of loan documents, closing and delayed-possession or early-possession agreements. She has also helped residential property owners with preparation of such legal documents as driveway and other easements and agreements affecting the use of their property.
• Representation of real estate brokers Sue Fox has a rarely-found depth of expertise in the representation of real estate brokers, having served as in-house counsel to a major national real estate brokerage firm and as a member of numerous Colorado Real Estate Commission task forces and committees, including many years on the Commission’s Standing Committee on Standard Approved Forms, the committee which develops all of the real estate forms approved for use by Colorado-licensed real estate brokers. Sue played a significant role in the development and refinement of Colorado’s real estate brokerage relationships statute. Her work in this realm includes development of legally-required office policy manuals for brokerage firms, development of forms for their use, representation of licensed brokers in their negotiations with their brokerage firms and representation of brokerage firms in negotiations with their licensed brokers. She also counsels brokers on their legal and ethical obligations, and helps them deal with issues raised by the Colorado Real Estate Commission. She has also assisted in the settlement of brokerage fee disputes between brokers as well as fee disputes between brokers and their clients.
